Complete Guide to Getting a NIE in Spain [2026]

The NIE (Número de Identificación de Extranjero) is Spain's tax identification number for all foreigners. If you are moving to Spain, buying property in Marbella or Fuengirola, starting a business in Málaga or simply opening a bank account on Costa del Sol, you will need a NIE. This 2026 guide covers everything — the legal basis, the process, the forms, the fees, and every situation you might face.

The NIE is created under Ley Orgánica 4/2000 sobre derechos y libertades de los extranjeros en España (the Foreigners Act), specifically developed in the Real Decreto 557/2011 (Regulations on Foreigners, Articles 196–213). It assigns every foreigner in Spain a unique fiscal identifier for all legal and economic transactions with Spanish public authorities.

The NIE consists of: a leading letter (X, Y or Z), seven digits and a final check letter — for example: X-1234567-A.

Key legal fact: The NIE is permanent and never changes. Spanish law prohibits the reassignment of a NIE to a different person. Even if you become a Spanish resident or citizen, your NIE remains your fiscal identifier for life.

NIE Certificate vs TIE Card — Critical Distinction

Many expats confuse these two documents. They are fundamentally different:

In simple terms: A NIE certificate proves you have a Spanish tax number. A TIE card proves you have the right to reside in Spain AND contains your NIE number. Many non-resident property buyers only ever need the NIE certificate — they never need a TIE.

Who Needs a NIE in Spain?

You need a NIE if you are a foreigner and you want to:

  • Buy or sell property in Spain — mandatory before signing the purchase deed (escritura pública) at any notary in Marbella, Fuengirola, Mijas or anywhere on Costa del Sol. Without a NIE you cannot sign, open the required bank account or pay ITP
  • Open a Spanish bank account — all Spanish banks require a NIE for account opening, even for non-resident accounts
  • Start a business or register as self-employed (autónomo) — the Spanish Tax Agency (AEAT) requires a NIE for all tax registrations
  • Sign an employment contract — Spanish social security and AEAT require a NIE for all employee registrations
  • File taxes in Spain — including the annual IRNR (Modelo 210) for non-resident property owners
  • Register a vehicle in Spain
  • Apply for any residency permit — the NIE is assigned as part of, or before, the residency process
  • Process an inheritance involving Spanish property or assets
  • Register a trademark at OEPM or file at EUIPO from a Spanish address
  • Apply for a mortgage with a Spanish bank

How to Apply for a NIE in Spain — Step by Step

Step 1: Determine your reason and gather justification

Under Real Decreto 557/2011, Article 196, you must provide a "motivo" (reason) for needing a NIE. The reasons accepted include:

  • Property purchase or sale (attach purchase agreement, promissory contract or arras contract)
  • Employment (attach employment contract)
  • Business registration (attach company registration documents)
  • Inheritance (attach documentation of inherited assets in Spain)
  • Tax obligations (attach correspondence from AEAT or Spanish tax authority)

Prudent note: Spanish authorities have discretion in accepting justification documents. We always review your documents before the appointment to ensure they are accepted.

Step 2: Complete Form EX-15

Formulario EX-15 (Solicitud de Asignación de Número de Identificación de Extranjero) is the official NIE application form. Download from the Ministry of the Interior website. It must be completed in Spanish and signed.

You will need to bring:

  • Original EX-15 + one photocopy
  • Original passport + photocopy of ALL pages (not just the photo page)

Step 3: Pay the official fee — Modelo 790-012

The government fee for a NIE application is €9.84 in 2026, paid via Modelo 790 Código 012 (Tasa por expedición del NIE). Available to download from:

Official government tax payment portal

Pay at any Spanish bank branch (Banco Santander, BBVA, CaixaBank, Unicaja etc.) before the appointment. Keep the bank-stamped receipt — you must present it at the appointment.

Step 4: Book your appointment (Cita Previa)

Book online at the official Ministry of Interior appointment system:

Cita previa for NIE and extranjería

Select: Province (Málaga), Office (Calle Mauricio Moro, 2 for Costa del Sol residents), procedure (NIE assignment).

Important: Appointment slots release at midnight on specific dates — the system fills within minutes. With our service, we monitor the system and secure your appointment promptly.

Step 5: Attend the appointment with all documents

Bring to the appointment:

1. Original passport + photocopy of ALL pages

2. Completed Form EX-15 (original + one copy)

3. Paid Modelo 790-012 receipt (bank-stamped)

4. Justification document (purchase agreement, employment contract, etc.)

5. For power of attorney: the original apostilled poder notarial

The appointment is at the Oficina de Extranjería de Málaga, Calle Mauricio Moro 2, 29006 Málaga for all Costa del Sol residents (Marbella, Fuengirola, Mijas, Benalmádena, El Higuerón, Estepona and the wider Málaga province).

Step 6: Receive your NIE certificate

The certificate is issued on the same day as the appointment in Málaga. It is a green or white A4 document (Certificado de Asignación de NIE) showing:

  • Your full name
  • Your NIE number (e.g. X-1234567-A)
  • Date of issue
  • Stamp of the issuing authority

The NIE is immediately valid. There is no activation period.

NIE Processing Times by Province (2026)

Waiting times vary significantly by province, time of year and demand. Peak season (July–September) adds 2–4 weeks across all provinces.

Getting a NIE Without Being in Spain

Two legal routes allow you to obtain a NIE without physically attending a Spanish appointment:

Route 1: Spanish Consulate in Your Country

Under Real Decreto 557/2011, Article 197, you can apply at any Spanish consulate or embassy abroad. Required documentation is the same as in Spain, plus:

  • Consulate-specific appointment (availability varies greatly)
  • Justification in Spanish or with sworn translation
  • Some consulates require the reason to be particularly compelling (property purchase is universally accepted)

Practical reality: Consulate appointments in London, Buenos Aires, New York and other major cities can take 8–16 weeks. We recommend this route only if you have ample time before your transaction.

Route 2: Power of Attorney (Poder Notarial)

The preferred route for property buyers and businesses. You sign a poder notarial before a notary in your home country, have it apostilled under the Hague Convention of 1961, send us the original, and we apply on your behalf in Málaga.

Cost breakdown for power of attorney route:

ItemApprox. cost
Notary in your country€80–200 equiv.
Apostille (UK: FCDO; USA: Secretary of State; Argentina: MRE)£30–100 equiv.
Sworn translation (if document not in Spanish)€50–100
Courier to Spain€30–50
**Total****€200–450**

This is by far the most popular option for international buyers purchasing property in Marbella, Puerto Banús and across Costa del Sol without needing to travel to Spain for the legal steps.

What Happens If My NIE Application Is Rejected?

Rejections are rare but do happen. Common causes:

Insufficient justification

The most common rejection reason. Solution: provide a more specific document that proves your need (e.g., a preliminary purchase agreement instead of a verbal commitment).

Prudent note: The decision of the officer is discretionary. We always review your documentation before the appointment to avoid preventable rejections.

Incorrect or incomplete Form EX-15

EX-15 must be completed correctly in Spanish. Even small errors (wrong date format, missing signature, incorrect boxes) can cause rejection. Our team completes and reviews EX-15 for all clients.

Missing documents at the appointment

If any required document is absent, the application is refused on the day. You must rebook another appointment — adding weeks of delay. Our checklist is comprehensive to prevent this.

What to do after a rejection

1. Request the written resolution explaining the reason (you are entitled to this under Spanish administrative law)

2. Correct the identified issue

3. Book a new appointment (through our service, we can often expedite)

4. Reapply — previous rejections do not affect subsequent applications

NIE for Specific Situations

Property Purchase in Marbella (Including Golden Visa)

Property buyers on the Golden Mile, in Puerto Banús or anywhere in Marbella need the NIE before signing the purchase deed. For Golden Visa purposes (investments of €500,000 or more under Ley 14/2013 de Apoyo a los Emprendedores), the NIE is the first step — before any property contract, bank account or visa application.

The NIE does NOT grant any residency or immigration benefit. It is purely a fiscal identifier.

Digital Nomad Visa (RDL 5/2023)

The Digital Nomad Visa introduced by Real Decreto-ley 5/2023 also requires a NIE. In this case:

  • EU citizens need the NIE as part of the EU Registration process
  • Non-EU applicants apply for the visa at the Spanish consulate abroad, where a NIE is assigned as part of the process

Company Formation / Autónomo

All shareholders and directors of a Spanish company (SL or SA) need a NIE before the notarial incorporation deed can be signed. Autónomos also need a NIE to register with AEAT (Modelo 036 or 037) and with Social Security.

Inheritance with Spanish Assets

Non-resident heirs inheriting Spanish property must obtain a NIE before they can accept the inheritance through a notary, pay ISD (Inheritance and Gift Tax) and register the property in their name. The 6-month ISD deadline begins from the date of death — delays in obtaining the NIE can incur interest if the deadline is missed.

Frequently Asked Questions About NIE Rejection and Validity

Can my NIE be cancelled or invalidated?

A NIE is a permanent fiscal identifier and cannot be "cancelled" in the traditional sense. However, under Instrucción DGP/SGRJ/2/2018, a NIE that has been inactive (no Spanish tax filings, no registry activity) for more than 5 years may be flagged for administrative review. In practice, non-resident property owners who file annual IRNR declarations never have this issue.

Can I use my NIE immediately after receiving it?

Yes. The NIE certificate is effective immediately upon issue. There is no activation period. You can present it at any Spanish bank, notary, tax office or registry the same day.

My NIE starts with X/Y/Z — what is the difference?

  • X — The original sequence, assigned from 1969 until approximately 2008. Example: X-1234567-A
  • Y — Introduced when the X sequence was exhausted. Currently in active use.
  • Z — Will be introduced when the Y sequence is exhausted. Not yet in general use as of 2026.

The letter has no practical legal significance — all three types have identical legal standing.

Do EU citizens need an EX-15 or EX-18?

  • EX-15: For any foreigner (EU and non-EU) who needs a NIE for tax purposes without registering as a resident (common for property buyers who will not live in Spain)
  • EX-18: For EU/EEA/Swiss citizens who are registering as residents (i.e. seeking the Certificado de Registro de Ciudadano de la UE)

A German or British citizen buying a holiday home in Marbella but not becoming a Spanish resident should use EX-15. A French citizen relocating to Fuengirola full-time should use EX-18.

What is the NIE for if it does not grant residency?

The NIE is Spain's way of tracking all economic activity by foreigners, regardless of whether they reside in Spain. Spanish law requires a NIE for:

  • All property transactions (to pay ITP/IVA and register the property)
  • All tax filings (IRNR, IRPF, IVA)
  • All employment relationships (social security, income tax)
  • All financial relationships (bank accounts, mortgages)

It is essentially Spain's version of a universal foreign taxpayer identification number — similar to the ITIN in the USA or the NI number in the UK.

NIE Numbers Under Special Circumstances

NIE for Minors

Children under 18 can be assigned a NIE. The parents or legal guardians sign the EX-15 on the child's behalf and provide the child's passport plus their own identification. This is commonly required for inheritance cases where minor children are heirs to Spanish property.

NIE for Deceased Persons and Estate Administration

If a NIE is needed for a deceased person's estate (for example, to liquidate Spanish assets), the administrator or executor of the estate applies using the deceased person's documentation plus proof of their own legal authority to act.

NIE in Urgent Property Transactions

If you need to close a property purchase quickly (common in competitive Marbella and Puerto Banús markets), we can apply for a NIE on an urgent basis. Under Instrucción SGRJ 4/2012, urgent NIE applications can be prioritised in cases of imminent notarial appointments. We liaise directly with the Oficina de Extranjería to expedite when timelines are critical.

NIE for Company Directors and Shareholders

Every director and shareholder of a Spanish company (SL or SA) must have a NIE before the notarial deed of incorporation can be signed. For companies with multiple international shareholders, we coordinate the NIE applications of all parties to ensure they are all obtained before the notary appointment — avoiding costly delays in company formation.

How Long Before Your Transaction Should You Apply?

TransactionApply at least
Property purchase (standard)4–6 weeks before signing arras
Property purchase (urgent)2–3 weeks with our expedited service
Company incorporation5–7 weeks before notary appointment
Golden Visa application (Ley 14/2013)4–6 weeks before property purchase
Digital Nomad Visa (RDL 5/2023)Before consulate application
Autónomo registration3–4 weeks before AEAT registration
InheritanceAs soon as possible after death — ISD deadline is 6 months

Our advice: Always apply for the NIE as early as possible. The one resource you cannot recover is time — and in Spanish property transactions, delays in NIE procurement can cause contracts to lapse, deposits to be forfeited and Golden Visa deadlines to be missed.
